The short answer
Dubai Customs can audit an import, export, transit or free zone declaration for five years after the goods clear, checking valuation, HS classification, origin and duty paid. Importers must keep the records behind each declaration for that period. A voluntary disclosure filed before an audit notice can reduce or waive fines.
How long can Dubai Customs look back?
Five years after the goods clear, and importers must keep the records that prove each declaration for the whole period; free zone companies keep customs records until the company is closed (Kayrouz & Associates, on Dubai Customs post-clearance audits). Clearance at the border is not the end of the matter: the declared value, tariff code and origin can all be revisited later.
What do customs auditors check?
Four things, mostly: the customs value (including freight, insurance and related-party pricing), the HS classification, preferential origin claims and whether goods under suspension regimes were accounted for. Selection is risk-based. High declaration volumes, frequent amendments, large refund claims and free zone stock gaps raise the odds of an audit (Kayrouz & Associates). Import VAT runs through the same declarations, so a customs finding often becomes a VAT question too.
How does customs voluntary disclosure work?
Under Customs Policy No. 58/2024, a business that reports its own error before Dubai Customs detects it pays the duty difference and may have fines waived in full or in part. The disclosure is filed electronically with supporting records, and the duty must be paid within 30 days of the claim or the disclosure lapses (Kayrouz & Associates). Once an audit notice arrives, disclosure is no longer available for the matters under review.
What does a customs health check involve?
A sample of declarations from the last five years tested against invoices, contracts, shipping documents and the ledger. We reconcile customs values to the accounts, test tariff codes and origin certificates, and check related-party pricing against the transfer pricing file, since the FTA can also look back five years on tax (Ministry of Finance). Errors found go into a disclosure plan before anyone asks.
Frequently asked questions
Do free zone companies face customs audits?
+
Yes. Free zone movements and stock are a common audit focus, and free zone companies keep customs records until the company is closed.
Can a customs error affect VAT?
+
Often. Import VAT is calculated on the customs value, so a valuation change usually changes the VAT too.
What if an origin certificate turns out invalid?
+
The preferential duty rate can be withdrawn and the full duty, commonly 5%, becomes payable on the affected goods.
